This summary is provided at or before the point we collect your personal information, as required by California law. Full detail follows below.

Who we are: La Pharmacie du Vin.

What we collect: Identifiers; customer records; commercial and purchase information; internet and device activity; approximate geolocation; visual information from security cameras; professional information from job applicants; inferences; and limited sensitive personal information.

Why we collect it: To take reservations, process orders and Wine Club memberships, verify that you are 21 or older, provide customer service, run marketing, secure our premises, and comply with law.

Do we sell or share your information: We do not sell personal information for money. We do share personal information for cross-context behavioral advertising through the analytics and advertising tools described in Section 7. You can opt out at any time.

Sensitive personal information: We do not use or disclose sensitive personal information for any purpose that would trigger a right to limit its use.

How long we keep it: See Section 8.

Your rights: To know, delete, correct, opt out of sale and sharing, limit use of sensitive information, and be free from discrimination. See Section 10.

1. SCOPE

This Privacy Policy ("Policy") describes how La Pharmacie du Vin ("we," "us," or "our") collects, uses, discloses, and retains personal information about visitors to lapharmacieduvin.com (the "Site"), guests at our restaurant and wine bar, retail and online customers, Wine Club members, tasting class attendees, and job applicants.

This Policy does not apply to the independent practices of third parties whose services you may use in connection with us, including OpenTable, Toast, Stripe, Squarespace, and social media platforms. Those companies handle your information under their own privacy policies, and we encourage you to review them.

Age restriction. La Pharmacie du Vin sells alcoholic beverages. The Site and our services are intended solely for individuals who are 21 years of age or older. See Section 13.


2. PERSONAL INFORMATION WE COLLECT

"Personal information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, as defined at California Civil Code section 1798.140(v)(1).

In the preceding 12 months, we have collected the following statutory categories of personal information.

A. Identifiers. Collected. Name, postal address, email address, telephone number, IP address, online account username, and unique device and cookie identifiers.

B. Customer records (Cal. Civ. Code section 1798.80(e)). Collected. Name, signature, address, telephone number, and payment card information processed by our payment providers.

C. Protected classifications. Collected. Age, and date of birth where you provide it, used to confirm that you are 21 or older. We also collect dietary restrictions, allergies, and accessibility needs where you disclose them with a reservation.

D. Commercial information. Collected. Reservation and dining history, retail and online purchases, Wine Club membership and pickup history, gift card purchases and balances, tasting class registrations, products considered, and order and cart activity.

E. Biometric information. Not collected.

F. Internet or other electronic network activity. Collected. Browsing activity on the Site, pages viewed, referring URLs, search terms, interactions with our emails and advertisements, device and browser type and settings, and session dates and times.

G. Geolocation data. Approximate location only, derived from IP address. We do not collect precise geolocation.

H. Audio, electronic, visual, or similar information. Collected. Closed-circuit television footage of public areas of our premises, and photographs and video from events, classes, and social media activities in which you participate.

I. Professional or employment-related information. Collected from job applicants only. Resume, employment and education history, work authorization, references, desired compensation, and background check results.

J. Non-public education information. Not collected.

K. Inferences. Collected. Preferences and characteristics drawn from the above, such as wine style preferences, visit frequency, and marketing segment.

L. Sensitive personal information. Collected on a limited basis. See Section 3.


3. SENSITIVE PERSONAL INFORMATION

California treats certain information as "sensitive personal information." We collect only the following:

Account log-in credentials, meaning a username in combination with a password, for accounts you create on the Site.

Health information, only where you voluntarily disclose it, such as a food allergy or dietary restriction provided with a reservation, so that our kitchen can accommodate you.

We verify age by visual inspection of a government-issued photo identification at the point of sale and at pickup. We do not scan, record, or retain identification numbers.

We use and disclose sensitive personal information only for the purposes permitted under California Civil Code section 1798.121(a) and its implementing regulations: to perform the services you request, to prevent fraud, and to ensure physical safety. We do not use it to infer characteristics about you. Accordingly, we are not required to offer, and do not offer, a separate "Limit the Use of My Sensitive Personal Information" mechanism. If our practices change, we will update this Policy and provide that mechanism.

We do not collect information about racial or ethnic origin, religious or philosophical beliefs, union membership, sexual orientation, or the contents of your mail, email, or text messages, and we do not process biometric information for identification purposes.


4. HOW WE COLLECT PERSONAL INFORMATION

Directly from you, when you:

Make a reservation, by phone, in person, or through OpenTable.
Dine, drink, or shop with us in person.
Place an order through the Site, including retail wine, gift boxes, and e-gift cards.
Join the Wine Club.
Register for a wine tasting class or private event.
Create an account or complete a profile on the Site.
Join our email list.
Connect to our guest Wi-Fi.
Contact us by phone, email, or the Site's contact form.
Interact with us on Instagram or Facebook, or participate in a giveaway, contest, or event.
Apply for a job with us.

Automatically, when you visit the Site, through cookies, pixels, tags, web beacons, and server logs. Our servers automatically record log data including your IP address, browser type and settings, referring page, and the date and time of your request. See Section 7.

From third parties, including:

Squarespace, which hosts the Site and our online store.
OpenTable, which handles our reservations.
Toast, our point-of-sale system.
Stripe, which processes payments.
Google and Meta, which provide analytics and advertising services.
Shipping and fulfillment partners for retail orders.
Background check providers, for job applicants, with your authorization.
A person making a reservation or placing an order on your behalf, in which case we rely on that person to have obtained your consent.


5. HOW WE USE PERSONAL INFORMATION

We use personal information for the following business and commercial purposes:

Taking, confirming, modifying, and managing reservations.
Processing and fulfilling retail and online orders, gift cards, and Wine Club memberships and pickups, including billing and recurring subscription charges.
Verifying that you are 21 years of age or older, as required by California law for the sale of alcoholic beverages.
Accommodating dietary restrictions, allergies, accessibility needs, and other preferences you tell us about.
Providing customer service and responding to your inquiries, requests, and complaints.
Sending transactional communications, including order confirmations, reservation reminders, Wine Club notices, and receipts.
Sending marketing and promotional communications, newsletters, event and class invitations, and customer satisfaction surveys, consistent with applicable law and your preferences.
Advertising and marketing, including delivering advertising on Google, Instagram, and Facebook and measuring its effectiveness.
Analytics, meaning understanding how the Site and our services are used and improving them.
Maintaining the security and integrity of our premises, systems, and information, including closed-circuit television monitoring of public areas.
Detecting, investigating, and preventing fraud, theft, security incidents, and other unlawful or harmful activity.
Auditing, internal recordkeeping, financial and systems management, and short-term transient use.
Recruitment and evaluation of job applicants.
Complying with legal obligations, including alcoholic beverage control, tax, employment, and health and safety requirements, and establishing, exercising, or defending legal claims.

We will not use your personal information for a materially different, unrelated, or incompatible purpose without providing you notice.

Closed-circuit television. We use video surveillance in public areas of our premises for security and loss-prevention purposes. By entering those areas, you acknowledge that your image may be recorded.


6. HOW WE DISCLOSE PERSONAL INFORMATION

In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose: A (identifiers), B (customer records), C (protected classifications), D (commercial information), F (internet activity), G (approximate geolocation), H (visual information), I (professional information), K (inferences), and L (sensitive personal information).

We disclose personal information to the following categories of recipients:

Squarespace, our website host and e-commerce platform. Categories A, B, C, D, F, G, K, and L.
OpenTable, our reservation platform. Categories A, C, and D.
Toast, our point-of-sale provider. Categories A, B, and D.
Stripe, our payment processor. Categories A, B, and D.
Google, for analytics and advertising. Categories A, F, G, and K.
Meta, operator of Facebook and Instagram, for advertising and audience measurement. Categories A, F, G, and K.
Email and marketing service providers. Categories A, D, F, and K.
Shipping and fulfillment providers for retail orders. Categories A, B, and D.
Security and closed-circuit television service providers. Categories A and H.
Background check and human resources providers. Categories A, B, C, and I.
Professional advisors, including accountants, auditors, and attorneys, as necessary.
Law enforcement, regulators, and courts, as legally required or permitted.
Acquirers in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, across all categories.

Service providers and contractors. Recipients that process personal information on our behalf are bound by written contracts that restrict them to processing the information only for the purposes we specify, prohibit them from selling or sharing it, and require them to maintain appropriate security.

Sale and sharing. We do not sell personal information in exchange for money. However, we use Google Analytics, Google advertising products, and the Meta pixel on the Site. These tools transmit identifiers and browsing activity to Google and Meta, who may use that information to deliver advertising to you across other websites and platforms. Under California law this constitutes "sharing" of category A, F, G, and K information for cross-context behavioral advertising. You may opt out at any time. See Sections 7 and 10.

We do not sell or share the personal information of consumers we know to be under 16 years of age.


7. COOKIES, ANALYTICS, ADVERTISING, AND YOUR CHOICES

The Site uses cookies and similar technologies, including pixels, tags, web beacons, and local storage, to operate the Site, remember your preferences and cart, measure traffic, and deliver and measure advertising.

We use the following categories:

Strictly necessary cookies, which are required for the Site, checkout, and account log-in to function. These cannot be disabled.
Functional cookies, which remember your preferences and settings.
Analytics cookies, including Google Analytics, which help us understand how the Site is used.
Advertising and targeting cookies, including the Meta pixel and Google advertising tags, used to deliver relevant advertising and measure its performance on other websites and platforms.

How to opt out:

Opt-out link. Use the "Do Not Sell or Share My Personal Information" link in the footer of every page of the Site.
Cookie preferences. Use the cookie banner on the Site to accept or reject non-essential cookies.
Opt-out preference signals. We recognize and honor the Global Privacy Control (GPC) and other browser- or extension-based opt-out preference signals as a valid request to opt out of sale and sharing for the browser or device transmitting the signal. If you are logged in to an account when you transmit the signal, we will apply your opt-out to that account as well.
Browser controls. Most browsers allow you to block or delete cookies. Blocking strictly necessary cookies may prevent parts of the Site from working.
Platform controls. You can manage advertising preferences directly with Google at adssettings.google.com and with Meta through your Facebook or Instagram ad settings.
Industry tools. You may also use the opt-out tools at optout.aboutads.info and optout.networkadvertising.org.

Opting out of advertising cookies does not stop you from seeing advertising. It limits the use of your information to personalize it.


8. RETENTION

We retain each category of personal information for the longest period consistent with the purposes described in this Policy and with our legal, tax, accounting, and alcoholic beverage control obligations, and no longer. Our retention periods are as follows:

Reservation and dining records: Three years after your most recent visit.

Order, purchase, and Wine Club transaction records: Seven years from the date of the transaction, supporting tax, accounting, and alcoholic beverage control recordkeeping.

Payment card data: Not retained by us. Retained by Stripe and Toast under their own terms.

Online account information: For as long as your account remains open, plus twelve months after you close it.

Marketing list membership: Until you unsubscribe. We retain a record of your unsubscribe request for as long as we operate our marketing list, so that we can continue to honor it.

Closed-circuit television footage: Thirty days, after which it is automatically overwritten, unless it is retained in connection with an active investigation or legal claim.

Job applicant records: Four years from the date of application, per California recordkeeping requirements.

Website log data and analytics: Fourteen months.

Where we are required to retain information for longer under applicable law, or where information is relevant to an active investigation or an actual or reasonably anticipated legal claim, we retain it for that additional period and restrict our processing of it to storage and security during that time. Once the applicable period ends, we delete, destroy, or deidentify the information.


9. SECURITY

We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, and unauthorized access. These include encryption of information in transit using current TLS protocols, access controls limiting employee access to what their role requires, secured physical storage of paper records, and network protections for our systems.

Payment card data you submit through the Site or at our point of sale is transmitted directly to, and processed and stored by, Stripe and Toast in accordance with applicable PCI DSS standards. We do not directly process or store full payment card numbers.

Please do not send us payment card numbers or other sensitive information by email.

No system of transmitting or storing information can be guaranteed to be completely secure. If we experience a breach affecting your personal information, we will notify you as required by California Civil Code section 1798.82.


10. YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, we honor the following rights, which reflect those provided under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, California Civil Code sections 1798.100 through 1798.199.100.

Right to know. You may request that we disclose the categories of personal information we collected about you, the categories of sources, the business or commercial purpose for collecting, selling, or sharing it, the categories of third parties to whom we disclosed it, and the specific pieces of personal information we hold about you. You may request information covering the 12 months preceding your request, or a period beyond 12 months, unless doing so would be impossible or would involve disproportionate effort.

Right to delete. You may request that we delete personal information we collected from you. We may deny the request where retention is necessary to complete the transaction or provide a good or service you requested; detect security incidents or protect against fraudulent or illegal activity; debug and repair errors; exercise free speech or ensure another consumer's right to do so; comply with the California Electronic Communications Privacy Act; conduct public-interest research to which you previously consented; enable solely internal uses reasonably aligned with your expectations; or comply with a legal obligation.

Right to correct. You may request that we correct inaccurate personal information we maintain about you, taking into account the nature of the information and the purposes of processing.

Right to opt out of sale and sharing. You may direct us to stop sharing your personal information for cross-context behavioral advertising. Use the "Do Not Sell or Share My Personal Information" link in the Site footer, or transmit a Global Privacy Control signal. We will not ask you to reauthorize sharing for at least 12 months after you opt out.

Right to limit use of sensitive personal information. As explained in Section 3, we use sensitive personal information only for purposes exempt from this right, so no limitation mechanism is required. If that changes, we will offer one.

Right to non-discrimination. We will not discriminate against you for exercising these rights, including by denying you goods or services, charging you a different price or rate, providing a different level or quality of goods or services, or suggesting that we will do any of these things. We do not offer financial incentives in exchange for personal information.

Verification. To protect your information, we must verify your identity before fulfilling a request to know, delete, or correct. We will ask you to provide information we can match against what we already hold, such as the email address or phone number associated with your reservations or orders, or details of a recent transaction. For requests for specific pieces of personal information, we apply a heightened standard and may require a signed declaration under penalty of perjury. We use information you provide for verification only for that purpose.

Authorized agents. You may designate an authorized agent to submit a request on your behalf. The agent must provide either a valid power of attorney or written permission signed by you, and we may require you to verify your own identity directly with us and confirm that you granted the agent permission. An opt-out request submitted by an agent does not require identity verification but does require proof of authorization.

Timing. We will confirm receipt of your request within 10 business days and respond substantively within 45 calendar days. If we need more time, we will notify you and may extend by an additional 45 days, for a total of 90 days. Opt-out requests are honored within 15 business days. There is no charge for these requests unless they are manifestly unfounded or excessive, in which case we will explain the basis before proceeding.

Appeals. If we deny your request in whole or in part, our response will explain why. You may respond to that decision using the contact points above, and you may also file a complaint with the California Privacy Protection Agency or the California Attorney General.


12. CALIFORNIA "SHINE THE LIGHT"

Under California Civil Code section 1798.83, California residents may request once per calendar year a list of the third parties, if any, to whom we disclosed personal information for those third parties' own direct marketing purposes during the preceding calendar year, along with the categories of information disclosed. We do not currently disclose personal information to third parties for their own direct marketing purposes. 13. MINORS AND AGE RESTRICTION

We sell alcoholic beverages. Our Site and services are intended only for individuals 21 years of age or older. By using the Site, making a reservation, or placing an order, you represent that you are at least 21. We verify age by visual inspection of government-issued photo identification at the point of sale and at Wine Club and retail pickup.

We do not knowingly collect personal information from anyone under 16, and we do not sell or share the personal information of consumers under 16. If you believe a person under 16 has provided us personal information, contact lapharmacieduvin@gmail.com and we will delete it.

Minors may lawfully accompany adults in our dining areas where permitted by our alcoholic beverage license. This Policy's age restriction applies to the Site, online ordering, the Wine Club, and alcohol purchases.


14. RESIDENTS OF OTHER UNITED STATES STATES

If you reside in a state with a comprehensive consumer privacy law, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others, you may have rights to access, correct, delete, and obtain a portable copy of your personal data, to opt out of targeted advertising and the sale of personal data, and, in some states, to appeal a denial of your request. Contact us using the methods in Section 11 and identify your state of residence. We honor universal opt-out mechanisms, including Global Privacy Control, where required.

We sell and ship within the United States only. We do not ship internationally.


15. THIRD-PARTY LINKS AND PLATFORMS

The Site contains links to third-party websites and services, including OpenTable, Stripe, and our Instagram and Facebook pages. We do not control and are not responsible for their privacy practices. Review their policies before providing information to them.


16. ACCESSIBILITY

We are committed to making this Policy accessible to individuals with disabilities. If you use an assistive technology and have difficulty accessing this Policy, contact lapharmacieduvin@gmail.com and we will provide the information in an alternative format.


17. CHANGES TO THIS POLICY

We review this Policy at least once every 12 months and may update it at other times. Changes take effect when the revised Policy is posted, and the "Last Updated" date at the top will reflect the revision. If we make material changes to how we handle personal information, we will provide additional notice, such as by email or a prominent notice on the Site. Your continued use of the Site after changes take effect constitutes acceptance of the revised Policy.
